Child Support

Child Support is the legal obligation of both parents to provide financial support to their children. Child support is paid by one parent to the other parent until 1) the child(ren) turns 18, or 2) until they turn 19, if they are a full-time student in high school, or until graduation, whichever occurs first. This type of order can be made in actions for Divorce, Legal Separation, Domestic Violence Restraining Orders, and Parentage actions. It can be raised by either parent independently or in connection with custody orders, and can be modified based on change in circumstances. Child support orders may include payments for additional expenses for the children. Several factors are considered in determining whether and how much one parent must pay to the other parent as support for their children including:

* Number of children
* Earnings (and sometimes earning capacity) of each parent
* How much time each parent spends with the child/children
* Medical and/or special education expenses for the children
* Tax related factors

California Child Support Principles:

* A parent's first and principal obligation is to support his or her minor children according to the parent's circumstances and station in life. This means, it is more important to pay child support than credit card bills, or any other bills.

* Both parents are responsible for the support of their children. Each parent should pay for the support of the children according to his or her ability.

* Children should share in the standard of living of both parents. Child support may improve the standard of living of the custodial household to improve the lives of the children.

* Child support orders should minimize significant differences in the children's living standards between the parents’ homes.

Guideline Support - California Courts use a mathematical formula to determine whether and how much one parent will pay to the other parent for the care and support of their children. Guideline child support is calculated on a computer program called DissoMaster. This program is used by family law attorneys and by judges, and is intended to encourage settlements of conflicts between parents, and minimize the need for litigation.
